Do I Have a Case for Domestic Violence?
If you or your children have been threatened with violence or have suffered abuse from a spouse, ex-spouse, domestic partner, dating partner, or someone you live with, you need to take action to protect yourself and your family. A petition for permanent protection – a Petition for Injunction for Protection Against Domestic Violence – can be filed.
These petitions have the power to:
- Assign temporary custody of your children to you
- Prohibit your abuser from contacting you at work, at home, via phone, email, or text
- Prohibit your abuser from coming within a specified distance of you
- Require your abuser to get court-ordered counseling
If your abuser violates the restrictions of the injunction, it becomes a criminal offense. In order to obtain such an injunction from the court, you will have to present evidence for your claims of domestic violence. Having an effective attorney at your side is essential in this matter.
In cases of immediate danger, a temporary emergency order may be obtained from the court for your protection. This order may also grant you temporary custody and additional protections.
