Child Custody

A Client received sole custody, School designation and sole decision making over her 8 year old son after Attorney Hamilton successfully argued that the Father’s ongoing domestic violence against the Mother in the presence of the child was not in the child’s best interest and that the Father was a danger to the child although he had never harmed the child. In this case the Father, that was the domestic violence abuser chased the Mother in his car around the neighborhood after he learned that she was having an affair. The Father would often belittle the Mother in the presence of the child and constantly threatened her. He did this in the earshot of the child and the child also developed intense anxiety because of this.

Child Support

A Client received $1,341.00 in ongoing child support per month after Attorney Hamilton successfully proved that the other Parent was earning more than minimum wage as a Lyft driver. The Father filed his financial affidavit and indicated that he was earning $800.00, per month as a driver. This was less than minimum wage. After successfully issuing subpoenas to the bank and Lyft, she was able to prove the Father was indeed driving full time for Lyft and earned far more than $800.00, per month, which resulted in ongoing child support in the amount of $1,340.00, per month and retroactive support owed in the amount of $14,751.00.

Alimony

A Client received durational alimony in the amount of $3,400.00, per month after a 39 year marriage where the Client was as a homemaker. The Client also received a sizeable lump sum payment as equitable distribution of the marital assets. This was after the other spouse told her she was not entitled to receive any additional money and offered her $1,000.00, per month and asked her to get divorced without a lawyer.

Alimony

A Client avoided paying alimony, in a 11-year marriage where there was a $45,000.00, income disparity between he and his Wife. Attorney Hamilton successfully argued that the Wife did not have a true need for alimony since their child was graduating and Husband was not responsible for providing for their adult child in college. A lot of the Wife’s expenses were for the child in college. The Wife continued to argue that she had to pay for the child’s college but legally the child is an adult and college is not a requirement to be considered for alimony purposes.

Child Custody

A client successfully relocated with their minor child to the state of New York, after Attorney Hamilton successfully proved that the other parent had very strong connections to the state of New York and traveled their frequently to meet with friends and family. It was not a question that the Father would still be able to maintain a close bond with the child despite the distance. In this case she proved the Father maintained a cell phone with a New York area code and in reviewing his bank records, the Father had transactions every month in the Manhattan area. Father tried to argue that he allowed someone else to use his debit card but the Court did not buy it.

Alimony

A client was successfully granted a continuance on the day of trial and was able to amend her pleadings to request alimony. The Client’s initial attorney had advised her that she was not eligible for alimony after a 11 year marriage where there was an income disparity of $16,000.00, and the Husband was much older than the Wife. Her last attorney told her that she did not have a chance. The Firm was retained 7 days before the scheduled trial. Attorney Hamilton was able to get a continuance granted on the day of trial and was able to have the pleadings amended to request alimony. The Court ordered the Husband to pay the Wife lump sum alimony in the amount of $600.00 per month for a 36 month period, to help her pay off her car.
